Simplification of the provision applicable as of 1 January 2018. In its press release dated 15 June 2017, the French Ministry of Finance announced a simplification of the law against fraudulent software, applicable as of 1 January 2018. This law exclusively concerns cash register software and systems, which are the primary sources of anti-TVA fraud. Invoicing and accounting software will not ultimately be concerned.

The press release is as follows:
“Combating fraudulent software – Simplification of provision applicable as of 1 January 2018.
In view of concerns expressed by companies, especially very small ones, concerning the implementation on 1 January 2018 of a provision of the French Finance Law for 2016 addressing the use of certified cash register, accounting and management software, the Minister of Public Action and Accounts, Gérald Darmanin, has decided to redefine and simplify the provision.
Only cash register software and systems, the primary sources observed for anti-TVA fraud, will be concerned.
Without reducing its effectiveness at fighting fraud enabled by the appearance of software which makes it possible to erase recorded revenue, the redefinition of the scope of the requirement makes it possible to reduce the complexity of this provision, concerning both initial measures for ensuring compliance and day-to-day company operations.
This modification will be set out in legislation by the end of the year and the provision will enter into force on 1 January 2018, as planned. Companies which have not yet taken measures to ensure the compliance of their cash register software therefore have 6 months to do so. The Minister of Public Action and Accounts has asked the tax authorities to provide support for companies in the first year of application of the new rules.”
